Why is Post Separation Support Needed?
Raleigh Post Separation Support (PSS), formerly known as alimony pendent lite, is very similar to alimony but is paid for a shorter term. PSS as it is often referred to, is support to be paid post separation and usually pre-divorce, or at least pre-alimony trial in effect.
In other words, PSS is support that is paid in the interim between separation and a trial on alimony. Why does it exist? Well, currently, it exists as a quick and easy way to ensure that a “dependent spouse” can financially survive until a trial on alimony can occur.
Should I Seek Post Separation Support?
Raleigh Alimony trials take months to prepare for and your case can often become slowed by an overburdened court system. PSS can be heard on affidavit alone, however in most cases it is heard in a very short (1 hour) hearing often within 45 days of making a claim in some counties.
It serves as a lifeline for a dependent spouse.
Other differences with alimony deal with the effectiveness, or lack thereof of defenses. PSS claims require immediate action and are subject to stringent local evidentiary rules as well that everyone should be aware of.
